Production terms and conditions
1. Usage: the agreed usage will be specified in the quotation and signed off by the client. The agreed usage is based on 8 hours (full day) and 4 hours (half day) for all suppliers. There will be no rebate if the period of time is less than specified in the signed quotation. If the client wants to use images other than for agreed usage, it will negotiate such use with the agency and will pay the additional fees. On confirmation by you of the booking we will require from you a signed purchase order with an acceptance of our standard terms and conditions.
1b. Buy out: images cannot be sold to, or used by, any other company other than the client who has signed the quotation and furnished arabianEye with an LPO.
2. Overtime: an overtime rate will apply to all bookings exceeding the duration periods above at a rate of 15% of the daily fee per every hour overtime. If the client requires a Model/Photographer’s release form, it is the client’s responsibility to provide it to the Agency prior to the booking for arabianEye perusal. On arabianEye approval it is the client’s responsibility to have the Model/Photographer sign the release before shooting commences on the day of the shoot.
3. Bad weather: the budget confirmed by you shall not include re-shoot or bad weather days for which further fees will be payable.
4. Digital processing includes: RAW processing, basic retouching of spot marks and leveling of colors only.
5. Quotations: costs in quotations are subject to change pending further briefing from client and are valid for 30 days only.
6. Payment: all invoices will be issued in the name of the client and will be addressed to the individual responsible for making the booking, unless otherwise agreed. Payment of all invoices is to be made in full within 45 days of the date of the invoice unless otherwise specified on the quotation. All fees are payable regardless of whether or not the client ultimately uses the images. The client shall have no right to use any of the Images taken until all fees are paid. The copyright for all images remains with arabianEye until all the full invoice is paid.
7a: If you are an agency acting on behalf of a client, you accept full responsibility for payment of our invoice, even in the event that your client does not reimburse for the amount of such invoice.
7b: 70% of total budget to be received prior to start of production or proof of transfer agreed upon. Remaining 30% of total budget to be paid 30 days after receipt of invoice, unless otherwise agreed.
7c: All invoices are to be paid in AED.
8. All props and wardrobe bought on your behalf remain the property of arabianEye.
9: Only at the point of receipt of the LPO can arabianEye begin working on your production.
10: Late payments in excess of 30 days will be charged the following: 3% of the total invoice bill for every month outstanding.
11: 4% added for all credit card payments.
12: Cancellation after signed LPO will be charged a rate of 2500 aed per every day of production and any other costs incurred on your behalf. Cancellation within 72 hours of commencement of job will incur a charge of 50% of total cost. Cancellation within 24 hours of commencement of job will incur 100% of total cost.
13: If a Booking is cancelled because of ill health of a member of arabianEye or some other reason beyond our control, we shall not be liable for any loss or damage suffered by the client.
14. Insurance: the Client shall be responsible for the crew’s health and safety. The client shall maintain adequate insurance cover to underwrite its obligations to the crew and shall indemnify arabianEye in respect of any claim by, for and on behalf of, the crew, for loss or damage in these circumstances.
15. Liability: arabianEye cannot be held ultimately responsible for the crew’s conduct on a shoot. arabianEye shall not be liable to the client for any indirect, incidental loss or damage, howsoever arising, in connection with the provision of the services. In no event shall the agency’s liability to the client, howsoever arising, in connection with the provision of the services, exceed the fees paid in respect of those services.
16. Governing Law and Jurisdiction: this agreement shall be governed by and be construed and interpreted and take effect in accordance with the laws in force in the Emirate of Dubai. In the event of dispute, these terms shall be subject to the exclusive jurisdiction of the courts of the Emirate of Dubai, UAE.
